Civil, Real Estate and Contracts
Regarding civil matters in general, the firm advises and represents consumers and businesses in matters involving personal property, real estate, contracts and other transactions and disputes. This includes negotiation, preparation and review of miscellaneous agreements and documents and advice appropriate to each client’s individual legal needs.
In the real estate field, this would include matters involving purchase and sale of property, broker and commission transactions, real estate financing matters, neighborhood issues, and special property rights and obligations such as: easement or right of way issues; common boundary or adjoining property issues; road maintenance agreements; homeowner association issues; and use restrictions such as restrictive covenants (CC&Rs) and zoning regulations.
Regarding Landlord and Tenant matters, we represent both landlords and tenants in commercial lease negotiations, drafting, and litigation. However in the area of residential property, we limit representation to landlords in drafting of rental agreements and leases, and litigation of tenant disputes, such as premises damage claims and eviction or unlawful detainer lawsuits.
Other general civil matters with which we assist clients include advising parties in contract disputes regarding broken promises and agreements; negotiation and drafting of contracts and other documents; and other general civil matters involving business and personal relationships.
Thomas E. Galyean has over 35 years of experience litigating cases as an attorney and he has served as a mediator, arbitrator, and settlement panel judge pro tem for the San Diego Superior Court for over 20 years. His fees for mediation services are $140 per hour, $400 per half-day (3 hours), and $750 per full day (6-7 hours).
